Young impaired rider is banned again
A young motorcyclist with a history of traffic convictions crashed his bike after drinking too much and ended up in court again.
Prosecutor Carrington Mahoney said police came across Nicholas Chilvers, 20, at 5.25am on Saturday, June 16.
They had been called to the scene of a “single-vehicle accident” on South Road in Smith’s. They observed Chilvers standing by his black auxiliary cycle which had the key in the ignition.
When they approached him, they noticed that he appeared to be intoxicated. However, he told the officers he “wasn’t drunk”. He said of the crash: “As I was coming up the hill, I lost control.”
When he provided a breath sample, it showed 160 milligrams of alcohol in 100 millilitres of blood, which is double the drink-drive limit. He pleaded guilty to driving with excess alcohol in his system when he appeared at Magistrates’ Court.
Mr Mahoney said Chilvers, a student from St George's, has previous convictions for similar offences.
The Royal Gazette reported in 2010 that Chilvers was fined and banned from driving for two years after he was caught behind the wheel of his mother’s car while drunk.
He was 17 at the time and pleaded guilty in Magistrates’ Court to driving while disqualified by reason of age and driving with excess alcohol.
That came less than a year after he pleaded guilty to riding a motorcycle while under the influence of alcohol.
Defence lawyer Craig Attridge said of the latest incident: “Mr Chilvers is very apologetic and remorseful.”
Senior Magistrate Archibald Warner fined him $800 and banned him from driving for a year.
