Man double the drink drive limit sent to DUI Court
A man who yesterday admitted being more than double the legal alcohol limit when he was involved in a crash was ordered to take part in a DUI programme.
Basil Gibbons, 57, pleaded guilty in Magistrates’ Court to drink driving.
The court heard that police were called to a two-motorcycle collision at the junction of Loyal Hill Pass and the Railway Trail in Devonshire.
Officers spoke to the motorists, one of whom was Gibbons, and suspected he had been drinking.
Gibbons admitted to drinking beforehand, but insisted that he was not responsible for the collision.
He told police: “I probably had six Heinekens, officer.
“I’m not going to deny it, I was drinking – I did have a few and I’m sorry.
“I’m sorry officer, but this accident was not my fault.”
Gibbons was taken to Hamilton Police Station where he agreed to take a breath test.
The breath test showed that Gibbons had 191.1 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80mg/100ml.
The incident happened on April 17.
Gibbons, from Devonshire, apologised for his actions and requested that he take part in the DUI programme.
Magistrate Tyrone Chin adjourned the case until November 24 and released Gibbons on $1,500 bail.
He also ordered a social inquiry report and a drug assessment.
