Tourist fined $3000 for cannabis possession

A cruise ship passenger was charged today in Magistrate’s Court with possession of cannabis with intent to supply.Kemper Hardy, a 24-year-old visitor from Oakland, California, was arrested yesterday.Customs officers discovered 28 grams of marijuana in his luggage aboard the Celebrity Summit during a random cabin search.Hardy pleaded guilty, but presented a medical marijuana card to Senior Magistrate Archibald Warner, stating that the drug was for personal use to relieve back pain. The card, issued by Hardy’s doctor in California, allows him to legally purchase and use marijuana in that state.Hardy initially claimed he did not know it was illegal to possess marijuana here, but later admitted that the cruise ship had signs saying controlled substances are illegal in Bermuda.Senior Magistrate Archibald Warner asked Hardy: “If you knew your right to possess marijuana was limited to California...it would be illegal, wrong and there would be consequences in any other state, why would you think any different for Bermuda?”Hardy said that he needed the marijuana for his lower back pain, but apologised to the court.“I made a big mistake,” he said.Mr Warner added: “One of our problem points is importing on cruise ships. Notwithstanding that we need tourists in Bermuda, tourists too should be discouraged from bringing drugs into Bermuda.”He initially sentenced Hardy to 30 days in prison, but reduced the sentence after considering that Hardy might lose his job in Oakland as a result of the jail time.Hardy received a 30-day sentence, suspended for two years, and a $3,000 fine.Hardy protested the fine amount, which was calculated based on the estimated $1,400 street value of the drug in Bermuda.Mr Warner replied: That’s why you should have smoked it in California. These are Bermuda prices.”
