Man cleared of affray, but guilty of threatening behaviour

A 19-year-old man who was tasered by a police reserve sergeant outside St George’s Cricket Club has been found not guilty of affray by Magistrates’ Court.

However, Bryce Daniels, of Wellington Slip Road, St George’s, was convicted by Senior Magistrate Archibald Warner of possessing an offensive weapon, plus engaging in threatening behaviour.

Daniels was arrested at the scene of a brawl outside Cup Match, on the evening of August 2, 2013, after Sergeant Steven McGuinness was alerted of the fight by security.

Sgt McGuinness told the court he saw five men in a “melee” outside the venue, striking one another with helmets at around 8pm.

Although the match itself had ended, Wellington Slip Road was full of people still queuing to get in.

Daniels has denied raising the helmet to strike the approaching officer, but Sgt McGuinness said he used the Taser after Daniels, holding up the helmet, said “You want some?”

The other four fled the scene. Two men later arrested on Kindley Field Road were cleared of charges after Mr Warner found that their identification by police wasn’t adequate.

Daniels, who had been ejected from the grounds earlier in the day, allegedly told the arresting officer “Seriously? I got tasered and I was the one just got jumped?” — and defence lawyer Javon Rogers maintained his client had been swinging the helmet in self-defence after being set upon by a group of men.

Mr Rogers said his client hadn’t threatened the officer, adding that “You want some?” was ambiguous, prompting Mr Warner to respond: “What was he offering him? Sandwiches?”

According to Crown counsel Loxly Ricketts, Daniels was cleared of taking part in a fight but will be sentenced for the other charges in due course.
