Corporation sues lawyer as dispute continues

A dispute over the legal representation of the Corporation of Hamilton has taken another turn with the municipality launching a law suit against one of the lawyers involved.

According to a writ filed last week, the Corporation has taken legal action against J2 Chambers and lawyer Eugene Johnston under the Municipalities Act 1923 and the Public Treasury (Administration and Payments) Act 1969.

Mr Johnston has represented the Corporation in the past. However, after Home Affairs Minister Sen Michael Fahy assumed stewardship of the Corporation a dispute arose over who now represents the municipality.

During a recent hearing in Supreme Court both Mr Johnston and lawyer Alan Dunch claimed they were the Corporation representatives.

While Mr Dunch had applied to end a constitutional challenge against the Government takeover, Mr Johnston argued that the stewardship order did not extend to legal representation and alleged that the takeover was orchestrated to halt the constitutional challenge.

The matter is expected to return to the Supreme Court later this week.
