Machete accused ‘at party during attack’

Two brothers accused of a reprisal attack on a teenager were said by witnesses to have remained at their home at a party around the time of the assault.

However, the Crown at the trial of Derek Weeks Junior and Javon Weeks suggested that both witnesses had been prompted to testify in favour of the pair, who are charged with possessing a bladed weapon and wounding with intent to do grievous bodily harm.

The pair, aged 28 and 30 respectively, reside at a Hermitage Road, Smith’s, address.

The Supreme Court heard yesterday that a barbecue with games had been held there on March 8, 2014.

Earlier the court had heard that 15-year-old Jahkumani Riley-Smith was set upon that night in a nearby waste area called “the jungle” and hacked with a machete as payback for stealing a moped from outside the house. Witness Tareek Webb-Caisey told the court he had arrived at the Weeks residence at about sunset with his girlfriend and her daughter, and left the party between 10pm and 10.15pm

The witness maintained that he had not seen Javon Weeks leave the premises, and that Mr Weeks had only left his sight to go to the bathroom.

Mr Webb-Caisey gave a similar account for the younger brother, and told prosecutor Alan Richards that the older brother’s jeep had remained outside.

Knrisha Tucker, the girlfriend of Javon Weeks, later told the court that he had remained at the house, and that she had taken his jeep out on a quick liquor run to Collector’s Hill just before the sale of alcohol stopped at 9pm.

Ms Tucker said she believed Mr Webb-Caisey and his group had left after 10pm, with the last guest leaving after 11pm.

She said she had seen Police in the area that night moving through adjacent roads. Officers appeared outside the residence in the early hours of March 9 and arrested her boyfriend.

Police were also seeking his younger brother, who lived upstairs at the address, but Ms Tucker had initially sent them to the downstairs door of Derek Weeks Sr because they had not specified which Derek Weeks they were seeking.

Mr Richards told her he believed her account of a party was “completely made up”, which the witness denied. He further suggested she came to court to lie on behalf of her boyfriend, to which Ms Tucker responded: “That is false.”

Closing submissions are expected today.
