Man fined and ordered to pay restitution

A 26-year-old Warwick man has been fined $300 and ordered to pay restitution for causing $1,825 worth of damage to a woman’s motorcycle.

Appearing in Magistrates’ Court this morning, Christyola Smith pleaded guilty to wilfully and unlawfully damaging the bike in Pembroke on March 2.

Prosecutor Alan Richards told the court that the complainant heard a lot of noise outside her house at about 6.30pm.

He said she saw three men surrounding her cycle and the defendant smashing up the bike with a baseball bat.

Mr Richards added that the defendant left once the complainant’s boyfriend intervened.

Police officers later recovered voice notes from the defendant to the complainant, in which he refused to pay for the damage.

Smith was arrested at Hamilton Police Station on April 27. He admitted damaging the bike but said that he thought it belonged to someone else.

Magistrate Khamisi Tokunbo handed Smith a $300 fine and ordered him to pay the $1,825 in restitution for the damage.

In a separate matter, a Warwick man who denied stealing items worth $27,300 from a property in Pembroke was granted bail.

Aaron Perinchief pleaded not guilty to the offence, which allegedly took place on October 28.

The 20-year-old is accused of entering the Spanish Point Road home as a trespasser and stealing a jewellery box and jewellery.

Mr Tokunbo granted $15,000 bail with a like surety and adjourned the matter to November 16 for mention.
