Man, 38, admits sexually assaulting woman

A 38-year-old Devonshire man has admitted sexually assaulting a woman.

Kevin Rubaine pleaded guilty in Magistrates’ Court this morning to committing the offence, which he had denied at a previous appearance, in Devonshire in December last year.

Prosecutor Larissa Burgess told the court that on December 4 the woman, who cannot be named for legal reason, was sitting in an aisle seat on a bus when the passenger next to her started making growling noises. She got up and Rubaine stood behind her, moving closer every time she tried to distance herself.

She felt something touch her right buttocks twice; she alerted the bus driver, who told the defendant to give the woman some space, and she also repeatedly told him to move away.

Ms Burgess said Rubaine did not move and, feeling violated, the victim got off the bus and called the police.

On December 6, the victim saw the defendant again and alerted police, who arrested Rubaine the next day.

During a police interview, Rubaine told officers that he had collided with the victim because of the motion of the bus.

Magistrate Khamisi Tokunbo ordered mental health reports and a social inquiry report.

A sentencing date was set for March 17 and Rubaine’s bail was extended.
