Woman awarded $55,000 waiting for payment

A cash-strapped woman owed more than $55,000 in compensation after a workplace accident has yet to get paid — nearly one year after she won her settlement.

Beverly Allen worked as a chef for Q’s Bar in Warwick in 2012 when she lost her footing on her way to the kitchen door, breaking her arm.

“I slipped on a rubber mat on my way in,” said Ms Allen, who fell on the ramp as she hurried inside from a downpour.

It later emerged in court that the ramp did not comply with the building code, with Puisne Judge Stephen Hellman ruling Ms Allen was entitled to damages as a result.

“I won the case in November last year, but they have not paid any money yet,” Ms Allen told The Royal Gazette.

“It’s not easy right now. I’ve been in court for bills that I owe.

“To be awarded and not be able to get it is just crazy.” The accident on November 14, 2012 fractured the humerus in her left arm, requiring surgery and leaving her out of work until May 2013.

Her children provided care over a six-month period, resulting in additional lost earnings.

On November 16 of last year, Mr Justice Hellman awarded a total of $55,836 in damages — but the establishment has since stopped business.

Ms Allen said she had been left with no idea when she would get paid. Former management for Q’s declined to comment, and their legal counsel did not respond.

Undaunted, Ms Allen said she planned to take her case back before the courts to get her settlement.

“If they had paid me my Workers’ Compensation, it wouldn’t have come to this,” she said.

“It’s been one thing after another for me. I need to get what I’m owed.”
