Gardner loses appeal against murder conviction

Jailed murderer Wolda Gardner has lost an appeal against his conviction for the shooting of Malcolm Augustus.

Gardner, 37, was sentenced on July 28, 2015 to 20 years behind bars before being eligible for parole, after a majority jury found him guilty 11 to 1 for premeditated murder, as well as using a firearm to commit an indictable offence.

Mr Augustus was shot dead near Wellington Back Road in St George’s on Christmas Eve, 2012.

The defence subsequently appealed the directions of Puisne Judge Charles-Etta Simmons in the submission of gunshot residue evidence to the jury, along with several other challenges to the direction of the trial.

However, the appeal was dismissed in a judgment handed down on January 30, available now on the Court of Appeal website.
