Two men banned from the road

A Pembroke man was banned from the road for three years and fined almost $5,000 for a series of traffic offences, including drinking and driving.

Mikael Raynor, 33, pleaded guilty in Magistrates’ Court to driving while over the legal blood-alcohol limit in addition to a series of other traffic offences.

The court heard Raynor was pulled over by officers at about 11.20pm on Friday during spot checks on Crow Lane in Pembroke.

During the stop, the officers discovered that the motorcycle he was riding was not licensed and Raynor was slurring his words. Asked if he had been drinking, Raynor admitted having four drinks and confessed that he did not have a valid drivers licence.

He later provided breath samples, which revealed that he had 166mg of alcohol in 100ml of blood — double the legal limit of 80mg.

Appearing in court this morning, Raynor pleaded guilty to driving while over the legal blood-alcohol limit, riding an unlicensed and uninsured motorcycle, and riding without a licence. He apologised, telling the court: “I just wanted to get home that night.”

Raynor also admitted a second series of traffic offences that occurred in April 2013, but denied a charge of taking a Yamaha motorcycle without consent between July 25 and July 28 last year.

Magistrate Khamisi Tokunbo banned Raynor from the road for three years for driving while over the limit, noting that he had a previous conviction for a similar offence. He also ordered that Raynor pay $1,550 in fines for the 2013 traffic offences and another $3,400 for the more recent convictions.

The magistrate further ordered that Raynor return to the courts on March 17 to stand trial for the charge of taking a vehicle without consent, releasing him on $1,500 bail.

A second Pembroke man, 24-year-old Donahue Sousa, was also banned from the road for drinking and driving, with the court hearing that the offence was his third in the last five years.

The court heard Sousa was stopped by police at about 3.45pm on Saturday after they recorded him travelling at 79km/h on Burnt House Hill in Warwick.

The officers noticed that his breath smelled of alcohol and that his eyes were glazed. Asked if he had been drinking, Sousa said that he had one drink that day.

He later provided officers with breath samples, which showed that he had 194mg of alcohol in 100ml of blood.

The court head that he had twice before been convicted of similar offences, both in 2010.

Mr Tokunbo banned Sousa from driving all vehicles for a period of three years and further fined him $2,000 for driving while over the legal limit. He further fined Sousa $400 for speeding and $1,250 for traffic offences that occurred in April 2014.
