Winston Albouy, 45, of Tribe Road Warwick, Richard Davis, 35, of Paynter's Lane, Sandys, Philip Fearon, 36, of Kingston, Jamaica, Joseph Hunt, 39, of Cedar Avenue, Pembroke, and Dennis Warren, 43, of Clarendon Road, Smiths were charged with conspiring to import cannabis between December 23 and January 14.

They were also charged with importing, possessing and handling the drug with intent to supply on January 12.

Crown Counsel Mr. Brian Calhoun said the case involved the importation of some four pounds of cannabis into Bermuda.

Mr. Calhoun said that four of the five accused are Bermudians, but he asked that a substantial bail be ordered in the case of Fearon who has no connections to the Island.

However, Mr. Archie Warner, who is representing Fearon and Warren, said that Fearon's bail should be no different from the other men.

Mr. Warner said the charges against his clients were vague at best and that bail should be granted at an amount that his clients could meet.

Senior Magistrate the Wor. Will Francis accepted Mr. Warner's arguments and set bail for each man at $5,000 with a like surety. He also required Fearon to surrender his travel documents and report to the Somerset Police Station every Wednesday between 6 a.m. and 6 p.m.

The same reporting conditions were set for Davis, who is represented by lawyer Mr. Peter Farge. Albouy represented by Mr. Philip Perinchief, and Hunt, represented by Marc Telemaque, and Warren will report to the Hamilton Police station every Wednesday between 6 a.m. and 6 p.m.

They will reappear in Magistrates' Court on March 11.

DISQUALIFIED FOR DRUNK DRIVING CTS A 21-year-old Pembroke man was fined $750 in Magistrates' Court yesterday and disqualified from all vehicles for 12 months after pleading guilty to driving while impaired and driving while disqualified.

Idrin Paynter, of Marsh Folly, admitted the offences which occurred on November 27.

Sgt. Peter Duffy, prosecuting, said Police saw Paynter riding a motorcycle west on Crawl Hill in Hamilton Parish. They followed Paynter and tried to get him to stop by putting on their sirens.

Paynter, who was disqualified at the time, turned off onto My Lord's Lane and attempted to avoid Police but fell off his bike.

Sgt, Duffy said his eyes were glazed and his breath smelled of alcohol. At St.

George's Police station, he refused to take an alco-analyser test.

"It's just something that happened,'' Paynter said, "I did not think I would have run into Police. I'm in the court's hands.'' Senior Magistrate the Wor. Will Francis fined Paynter $450 for driving while impaired, and took him off the road for 12 months, and a further $300 and 12 months disqualification for the disqualified driving offence. Both disqualification periods will run concurrently.

SOCIAL INQUIRY REPORT FOR TEENAGER CTS Teenager Linda Astwood was this week ordered to see probation officers for a social inquiry report after she pleaded guilty to stealing more than $200 from a woman.

Prosecuting, Insp. Peter Duffy told Magistrates' Court that Astwood, 16, stole the money from a purse laying on a sofa in a Somerset home.

The theft occurred on the afternoon of last December 19 and was reported by the occupant two days later after she discovered $210 missing.

Astwood, of Hamilton Parish, was arrested in January as a result of information received.

She told Police she did not remember what she did with the money, Insp. Duffy said.

Senior Magistrate the Wor. Will Francis ordered Astwood to appear for sentencing on March 3.

MAN FINED $300 FOR DRUG OFFENCES CTS A 41-year-old Pembroke man, who pleaded guilty to possessing drug equipment, was fined $300 in Magistrates' Court yesterday.

Easdale Dawson of Market Lane admitted the offence that occurred on October 8.

Sgt. Peter Duffy, prosecuting, said Police went to Dawson's house with a search warrant. In a small room next to his apartment, they found a test tube, a teaspoon, glass tumbler, glass pipe, silver foil, razor blades, and a pen knife.

Police arrested Dawson and he admitted that he used the small room to smoke crack cocaine.

The test tubes, glass pipe, silver foil and the tumbler all tested positive for the presence of cocaine.

Dawson apologised for the offence, but said he had stopped smoking crack a month ago.

Senior Magistrate the Wor. Will Francis told Dawson to get some help for his addiction before he imposed the $300 fine.

MAN CHARGED WITH CURRENCY OFFENCES CTS A Pembroke man was charged in Magistrates' Court this week with 35 counts of violating foreign currency exchange regulations.

The Crown alleged Ernest Seymour, 25, got more than US$53,000 from local banks by falsely stating on his Bermuda Monetary Authority forms that he needed the money to vacation abroad.

As a result, he was exempted from the foreign currency purchase tax, said Crown counsel Ms Sharon Kenny.

Seymour was also charged with failing to return the US money to the bank when he did not go abroad during the periods he stated on his forms.

The alleged offences occurred between last March and May, Ms Kenny said.

Seymour was not required to plead to the charges which must be tried in Supreme Court.

He was bailed in the sum of $1,000 and asked to appear for mention in plea court on March 3.

WOMAN GUILTY OF DRIVING WHILE DRUNK CTS A St. George's woman was fined $450 and taken off the road for 12 months in Magistrates' Court yesterday after she pleaded guilty to driving while impaired.

Angel Kerstie Neumann, 29, of Ferry Road, admitted the offence that occurred on January 6.

Insp. Peter Duffy prosecuting, told the court that Police attended the scene of an accident on St. David's Road. There was a private car in front of the Blackhorse Tavern. Neumann who was travelling west, had tried to overtake another woman and a collision occurred.

Police found Neumann to be very talkative and her eyes were glazed and her speech was slurred. She told Police she does not drink and that she was only driving at 25 mph as she tried to overtake the woman.

An alco-analyser test revealed that she had 127 milligrams of alcohol in 100 millilitres of blood.

"I think I'll eat before I drink a glass of wine next time,'' Neumann told Senior Magistrate the Wor. Will Francis, before he fined her $450 and disqualified her from all vehicles for 12 months.
