The classroom where an eight year old claimed he had his penis pulled by a teacher was recreated in Magistrates' Court yesterday.

Two small plastic chairs and a small desk were brought into court by defence counsel Larry Mussenden as he continued the cross-examination of the pupil who claimed he was assaulted by a 33-year-old teacher during a lesson in January.

The eight year old, who cannot be named for legal reasons, faced another 75 minutes of questioning in a closed court after sitting through an uncomfortable 90 minutes on Monday.

He was asked to sit at one of the plastic chairs to show the court the exact position he was sitting in when the teacher was alleged to have sat next to him and pulled his penis.

The court heard that when the teacher had pulled the boy's penis, the child said: "Why are you doing that Uncle (X)?" (For legal reasons The Royal Gazette cannot give the accused's first name.)

He then told the court: "Some people call him Uncle (X) for a short name."

Mr. Mussenden continued to cross-examine the boy about the details of the assault, leading to confusion over the exact time the incident took place, the number of children in the class and where the other children were sitting at the time.

Discrepancies between what the youngster said to Police in a video-taped interview and what he told the court were found by Mr. Mussenden leading to him ask: "Do you get mixed up about a lot of things?"

"No, not a lot of things," the youngster responded.

Acting Senior Magistrate Will Francis later asked: "Are you making this up?" to which the boy once again answered: "No."

The case was adjourned at 10.30 a.m. as Mr. Mussenden had to leave for a business trip to the US. It is set to resume at 9.30 a.m. on October 23.
