A teacher touched the hair of two pupils before pulling the penis of one of them, a court heard yesterday.

And the classroom where an eight year old claimed he was sexually assaulted by the 33-year-old teacher was again recreated in Magistrates' Court as the trial resumed after a two week break.

The youngster, who cannot be named for legal reasons, took the witness stand for his third session of rigorous cross-examination by defence counsel Larry Mussenden over the incident, which is said to have taken place in January.

Two small plastic chairs and a small desk were brought into court by Mr. Mussenden as he continued to uncover inconsistencies in the youngster's story.

During the gruelling three-hour session, during which both the youngster and Acting Senior Magistrate Will Francis appeared to be confused about the description of events that took place in the classroom, the pupil admitted "I'm getting mixed up."

Discrepancies were found by Mr. Mussenden over what the youngster told the Police the week after the incident and what he was telling the court, over details such as where the child's hands were when the teacher allegedly pulled his penis, what was said by the teacher and the youngster and whether or not he had switched seats with another pupil, who was also said to have had his hair touched by the teacher.

The court also heard how the youngster, despite being "mad" at the teacher and still having a "stinging penis", went to the teacher's classroom with other pupils to get candy after school.
