quashed a Magistrate Court sentence for corrective training.

Jerkeyo Berkeley was sentenced to corrective training by Magistrate Edward King in December of last year after the Alexandra Road resident admitted breaking into a storeroom in order to steal spray paint.

But his lawyer Elizabeth Christopher launched a successful appeal of the sentence in Supreme Court and Berkeley was given two years probation.

Ms Christopher pointed to a psychological report on Berkeley which showed the young man was trying to improve himself and Crown counsel Leighton Rochester offered no objection to the alternative sentence.

In quashing the original sentence, Puisne Judge Norma Wade-Miller said she hoped Berkeley appreciated the time and effort people had spent to get him back on track.

"Everyone wants to see you do well. You must see that.'' "From all accounts,'' she continued, "you are doing quite well. It's all up to you now.'' She ordered Berkeley to continue meeting with his therapists and warned that if he failed to do this, he would end up back in court and then be sent to corrective training.

"Stay away from the bad company,'' Mrs. Justice Wade-Miller warned him. "Be a leader. I don't expect to see you back here.'' TRIO DENY DEPRIVING MAN OF HIS LIBERTY CTS Trio deny depriving man of his liberty Three Pembroke men denied in Magistrates' Court depriving a man of his liberty and causing him grievous bodily harm.

The men, Marcel Reid Rubaine, of Secret Lane, Sergio Augustus, of Angle Street, and Damany Burchall, of Ewing Street, are accused of being concerned together in depriving Tyari Harvey of his liberty between June 25 and 26.

The three men also deny being concerned together in injuring Mr. Harvey between those dates.

Senior Magistrate Will Francis issued a warrant for another man, Shawn Eugene Harvey, who will also be charged with the two counts.

Rubaine, 20, Augustus, 18, and Burchall, 18, were released on $500 to return for trial on January 22. Augustus and Burchall must provide one surety in a like amount.

MAN WHO FLED POLICE HAD CRACK PIPE CTS Man who fled Police had crack pipe The Senior Magistrate fined a Smith's Parish man $350 for running from a Policeman and having a crack pipe.

Jelani Randall Tweed, of Douglas Close, admitted to Senior Magistrate Will Francis he ran from Police on Angle Street shortly before 10 p.m. on June 26.

Crown counsel Charmaine Smith said when Police found him two minutes later on Elliot Street, Tweed said: "OK, I have a crack pipe in my right pocket.'' He was searched at Hamilton Police Station and a pipe -- later found to have traces of cocaine -- was found in his right front pocket.

Tweed had nothing to say before Mr. Francis fined him $200 for obstructing the Police and $150 for having the crack pipe. He must pay the fine by the end of October.

Derek Simons, of Upland Street, pleaded guilty yesterday before Senior Magistrate Will Francis to stealing the spirit on August 20.

Crown counsel Charmaine Smith said that about 7.20 p.m Simons was watched by security camera and staff put a bottle in a bag and then purchase two cans of beer.

He was confronted outside the building and was found to have a $9 bottle of Smirnoff Vodka.

Simons, 43, later admitted the offence while being questioned by Police.

He told Mr. Francis: "I purchased the merchandise and I was going to pay for the bottle but a taxi driver outside was trying to tell me I had dropped some money.''
