Hamza civil case hears of hurtful e-mail

Amanda Hamza, the second wife of the late Dr. Mohamed Hamza, sent a group e-mail to his daughter, Alia, apologising for ?wishing cancer? on Dr. Hamza?s first wife, the court yesterday in the civil case between Dr. Henry Subair and Amanda Hamza.

Giving testimony yesterday, Alia said following Dr. Hamza?s return from medical treatment in Boston on April 26, 2001, she received a group e-mail from Amanda Webster (now Hamza) giving details about his treatment.

But she became angry when she later received an apology from Amanda for making the statement: ?Why does God choose the good ones, why couldn?t he have chosen that b**** (referring to Dr. Hamza?s first wife, Sue Hamza).?

Alia said the next day she called Amanda expressing her displeasure at family affairs being exposed over the Internet to people that knew her mother for many years.

When Dr. Hamza returned from Boston, Alia was shocked and disappointed to hear from him that he had decided to remarry as he had said he would never remarry because his first marriage had ended acrimoniously. He also knew he was terminally ill with lung cancer.

Conflicting claims about payments made by Amanda Hamza from the estate of the Dr. Hamza have dominated proceedings in the case

Dr. Subair, as one of the executors for the estate of Dr. Hamza, who died on May 22, 2001, is claiming it was not Dr. Hamza?s intention to make a gift of part of his estate ? an account with Bermuda Eye Care and an account with Bermuda Savings & Loan ? to his second wife.

Dr. Subair said Mrs. Hamza had agreed to hold on to the Bermuda Eye Care in trust but she appropriated the entire account, containing half a million dollars ? a breach of trust he claimed. Mrs. Hamza?s lawyer Mark Diel contends she did not agree to this and was entitled to a substantial part of Dr. Hamza?s estate, if not the entirety.

The case continues tomorrow in Supreme Court.
