One of the four companies accused of evading taxes had the matter settled in Magistrates' Court yesterday when Raymond Emery received a conditional discharge.

Emery appeared on behalf of his company Emery's Paint Shop in Warwick, which allegedly owed Government $27,820.59 in taxes, covered by 45 counts with the primary charges being failure to pay taxes, failure to file a return and failure to pay penalty imposed.

In the last court appearance, Emery said that he was in the process of paying Government back what he owed at a rate of $1,000 a month on the taxes he owed, something to which Mr. Greaves thought should have been paid faster.

Mr. Greaves said that paying $1,000 a month was not enough and that he should find a quicker way to pay the money and said he would give Emery some time to get a payment plan worked out.

Emery took Mr. Greaves advice and took out loans with the Bank of Bermuda who paid the money back to Government yesterday.

"I see no reason to further inflict monetary penalties on him," said Mr. Greaves.

Mr. Greaves gave Emery a two-year conditional discharge and told Emery that if does anything he would be back before the court and could face a prison term.
