the arresting officers to mark him down as failing the alco-analyser test and let him go back to the bar.

Gerald Gordon Leck, 48, of Garthowen Road, appeared in Magistrates' Court for driving while impaired and not possessing a valid driver's licence and was fined a total of $1,100 and was disqualified from driving for a year.

Crown counsel Graveney Bannister told the court that around 11.44 p.m. on July 5, a Police vehicle was travelling east on Middle Road, Devonshire, when an oncoming white van veered into its path.

The Police car swerved to avoid hitting the van and nearly went over a nearby embankment.

Police pursued the vehicle, which continued to travel west. When they stopped the van, the officers found Leck to be incoherent and smelling of alcohol.

Mr. Bannister said Leck had to be assisted out of the van's driver's seat, was unsteady on his feet and collapsed onto the Police car.

Leck was tested and found to have 271 milligrammes of alcohol in 100 millilitres of blood. The legal limit of alcohol is 80 milligrammes.

While at Hamilton Police Station, Leck refused to take a second test and said: "Put me down as a failure, so I can get back to the bar.'' Senior Magistrate Archibald Warner shook his head and asked if Leck had anything to say about the incident.

"It was very stupid of me to drive,'' Leck responded. "I am sorry, Your Honour.'' Mr. Warner fined Leck $1,000 for driving while impaired, $100 for driving without a valid driver's licence and disqualified him from driving vehicles for a year.

FINE DODGER SAYS: `SEND ME TO WESTGATE' CTS Fine dodger says: `Send me to Westgate' Westgate Correctional Facility would be a welcome alternative to having to pay more than $1,900 in fines, said a Warwick man who appeared in Magistrates' Court this week.

Satanjee Devent Joell, 24, of Keith Hall Road, appeared before Senior Magistrate Archibald Warner for a series of outstanding fines and missed court dates and was sent to jail for 60 days.

Mr. Warner read the charges to Joell who said he had lost track of his offences.

The court heard that on March 26, Joell was stopped for speeding at 62 kph and not possessing a valid driver's licence.

He was fined $235 for the speeding offence and $200 for not having a valid driver's licence.

Joell also missed a court date on April 20 for speeding at 59 kph on March 25.

He was fined $220 for that offence.

And the court heard Joell already had outstanding traffic fines amounting to $1,200.

Mr. Warner asked: "So why did you miss your court date?'' Joell replied: "Because I was laid off and I lost all the tickets, but I called prosecutions so that they could give me another court date.'' Mr. Warner replied: "I don't believe you. You can't call prosecutions to get a court date, you were supposed to come to court. So you're going to pay all these fines today!'' Joell told Mr. Warner he was unable to pay the fines because he had been unemployed until Monday.

"You know it never ceases to amaze me the start up date of employment is right before a court date,'' Mr. Warner said. "These fines have to be paid today.'' To that Mr. Joell replied: "Well I'm going Westgate. You might as well put them all on one bill and send me Westgate.'' "Cool with me,'' Mr. Warner said. "I'll give you a discount at Westgate, 60 days for free.'' PSYCHIATRIC REPORT ORDERED FOR BURGLAR CTS Psychiatric report ordered for burglar A 35-year-old Sandys Parish man will undergo a psychiatric assessment before being sentenced by the Supreme Court for burglary.

Tyrone Howard Berkeley, of the Railway Trail, pleaded guilty to stealing cash from David and Susan Mutch on May 22.

Crown counsel Graveney Bannister said Mrs. Mutch saw Berkeley in her Smith's home around 10.30 a.m. and told her husband who called Police.

Berkeley ran into a bathroom and locked himself in before climbing out the window and catching a bus in Flatts Village.

He was spotted by Police boarding the bus and officers were waiting at the Hamilton Bus Station when he arrived.

Berkeley tried to run away through Victoria Park but was nabbed.

Berkeley was sentenced to three years in jail in 1998 which was to be served between the Westgate Correctional Facility and the Salvation Army Care facility.

When he was arrested for the latest matter he was in violation of that sentence.

Mr. Bannister said: "It is obvious Mr. Berkeley has not taken heed. The public needs to be protected. Some kind of deterrent needs to be set when sentence is passed.'' Defence lawyer Richard Horseman requested that a psychiatric evaluation be carried out.

Mr. Justice Ward said: "I have been in the court system a long time -- back when they used to give them shock treatment.

"A little shock treatment might help. Things might look up.'' Berkeley was remanded in custody and will return to court on September 1 when the evaluation is set to be completed.

FOURWAYS WAITER FINED FOR DRUNK DRIVING CTS Fourways waiter fined for drunk driving A waiter at Fourways Inn who refused to take a drink driving test was disqualified from driving all vehicles for 12 months and fined $1,000.

Didier Chanteloup, 34, of Middle Road, Paget, pleaded guilty to riding while impaired on June 29 when he was seen riding unsteadily on a livery cycle by Police on Par-la-Ville Road at 3.25 a.m.

When officers stopped him they noted Chanteloup's speech was slurred and asked if he had been drinking. He replied: "Yes. Why did you stop me?'' Chanteloup was arrested and taken to the Hamilton Police Station where he refused to provide qualified technicians with breath samples at 4.20 a.m.

Yesterday he had nothing to say before Senior Magistrate Archibald Warner sentenced him.

JOY RIDE AT SEA COSTS ST. DAVID'S MAN CTS Joy ride at sea costs St. David's man An evening joy ride in a stolen boat cost an unemployed St. David's man $800 in Magistrates' Court yesterday.

Kenneth Noell DeSilva pleaded guilty to taking a boat belonging to Jurgen Dale without his permission on June 23.

Senior Magistrate Archibald Warner heard Mr. Dale moored the 13-foot Boston Whaler in St. George's that morning and noticed it was missing at 7.40 p.m..

On June 26, Police found the boat overturned and semi-buried in the sand at Grape Bay. There was minimal damage to the hull but the engine required extensive repairs.

At 8.40 a.m. on June 30, DeSilva was arrested and admitted he stole the boat.

He told Police: "I used the boat for a joy ride after a few beers.''
