Yesterday lawyer and Bermuda Cricket Board of Control president Ed Bailey successfully argued for Smith's original March 14 sentencing date to be put back.

He told Senior Magistrate Will Francis that Smith was leaving Bermuda on March 15 to take part in a cricket tournament in Malaysia.

Mr. Bailey said it could prove disruptive to the tour party if Smith was sentenced on the eve of the team's departure.

Smith, 24, was one of four Hamilton Parish men who pleaded guilty to spearfishing and taking a protected fish -- parrot fish -- on October 28.

The others were Kevin Carter, 20, Scott Gibbons, 26, and Marty Lema, 34.

Carter also pleaded guilty to an additional charge of taking lobsters via spearfishing.

The maximum sentence the four men face on each charge is a fine of up to $5,000 and/or a year in prison.

Mr. Francis originally adjourned the case until March 14 and granted each man bail in the sum of $500.

But yesterday he agreed to delay Smith's hearing until after the cricket tournament.

And yesterday he appeared at Magistrates' Court where he admitted the charge.

Sorrentino, of Ferrars Lane, Pembroke, was granted $500 bail, with like surety, and the case was adjourned until April 14 for a social inquiry report.

Prosecutor Sgt. Phil Taylor said Police were called at 11.40 p.m. on February 8 to the Cock and Feather following reports of a disturbance.
