Object in road used in fight – claim

A woman accused of slashing another woman's face with a broken bottle told a Supreme Court jury she grabbed something on the ground and hit the woman to get her off her.

Sharde Dorika Hassell, 21, and Janika Ashley Powell, 22, are both charged with causing grievous bodily harm to Janai Caldwell. They deny the charges. Proceedings against Christopher Lima Ferreira, 22, were discontinued by Deputy Director of Public Prosecutions Michael McColm on Monday.

Both Hassell and Powell took the stand as defence witnesses.

Hassell told the court she arrived at the Mid Atlantic Boat Club on Friday, May 25 with Powell, Tiffany Smith, Mr. Ferreira and Powell's mother Lorna.

She said the group excluding Mr. Ferreira stood next to the jukebox talking and dancing with drinks in their hands when she was bumped twice by Ms Caldwell causing her drink to spill on Ms Smith's shoes.

The jury heard Ms Smith turned around and asked Ms Caldwell to move back because she was bumping Hassell. The witness told the court she saw Ms Caldwell's head and hand moving but she couldn't make out what was said.

After a few minutes, Hassell said she noticed Ms Caldwell had left but soon returned behind her dancing and holding a drink above her head.

Hassell told the court she asked Powell to switch places with her. Later in the night after the group had moved to the dance floor, Hassell said she felt someone push through the group without saying excuse me causing her to bump into Powell.

Hassell said when they walked out of the club, she was given an opened Twisted Tea bottle by Ms Smith but only drank a few sips and threw it out before she left the club.

She said she saw Ms Caldwell and her friend, Jennifer Achadinha driving out and Ms Caldwell had her head out of the window saying something. Ms Smith then threw a drink at the car, the jury heard.

A few moments later, Hassell said she saw the girls drive back across the club at a slow speed. She said the group got into Mr. Ferreira's car and ended up behind the girls.

The court heard Mr. Ferreira beeped his horn and drove up next to the car in front but didn't overtake. She said the car stopped after the stoplight by the tennis stadium on St. John's Road so they stopped as well.

Hassell told the court Janai got out first followed by Jennifer walking "pretty fast". She said Ms Smith was the first to get out of their car followed by Powell and herself when an argument broke out between Ms Smith and Ms Caldwell.

"I was standing there laughing and Jennifer was pulling Janai's arm to tell her 'let's go get back in the car'. I saw Janai pull her away and say, 'I want to know what's wrong with them, what's their problem'. Janai said, 'You girls don't know me and what I've been through the past two months. I said. 'You don't know me and what I've been through the past 20 years."

Hassell continued: "She grabbed me by my shirt and flung me on the ground. She was on top of me. Not leaning over me, she had her weight on me and I couldn't breath. I started to scream and hitting her to try to get her off me. She was pulling my hair, banging my head to the ground, punching me in the face and I was trying to fight back."

"My hands were in the road so I reached out and grabbed something. I don't know what it was and I hit her with it."

During cross-examination, Hassell said even though her head was banged on the ground repeatedly, she didn't have any bumps. However, she said she got a bad headache as a result.

Even though she admitted hitting Ms Caldwell with an object she picked up off the ground, she said she wasn't able to say what that object was.

In her evidence, Hassell told the court after the fight, the group went to Swinging Doors night club to party some more. Mr. McColm asked: "You've got a headache. You've been bashed up and you still want to go to a party?" Hassell said yes.

Powell told the court at no time did she ever touch Ms Caldwell. She said she saw Ms Caldwell push Hassell to the ground and saw both of them punching each other. She also said she heard Hassell screaming for someone to pull Ms Caldwell off her.

Powell said she went over to help Hassell when she was punched in the midsection by Ms Caldwell but didn't react because it was a light punch.

The jury heard she went over, picked up Hassell's cell phone and shoes and got into the car to leave. Powell told the court at no time did she see broken glass or blood coming from Ms Caldwell's face.

During cross-examination, Powell said she didn't see any bruises on Hassell's face but did see cuts on her neck once they got into the light.
