Carlos Manuel Pacheco, 41, of Lantana staff quarters, appeared in Magistrates' Court yesterday to plead guilty to committing an act of indecency in a public place.

Crown counsel Juan Wolfe told Senior Magistrate Archibald Warner that plain clothes Police officers were on patrol in Barrs Bay Park Pembroke, in the early hours of July 15 when they spotted Pacheco and another man having a conversation. The pair then disappeared into some bushes.

When officers approached the area with flashlights, they saw Pacheco kneeling down performing oral sex on the other man.

Both men were arrested, taken to Hamilton Police Station and charged jointly with the offence.

In defence of his actions, Pacheco told Mr. Warner: "This is the first time this has happened to me. I've been in Bermuda for 15 years and I've never had this problem.'' Mr. Warner replied: "Mr. Pacheco this is a public place, you have to be careful of what you put in your mouth. They sell ice-cream cones down the street.'' Mr. Warner fined Pacheco $500 for the offence.

Pacheco's co-defendant was supposed to appear in court yesterday to face the same charge but failed to appear.

REPEAT OFFENDER BACK IN COURT CTS Repeat offender back in court Brian Carlton Rogers has appeared in court to face charges of breaking and entering and depriving a woman of her liberty.

Rogers, 40, of Cut Road, St. George's, was charged with stealing from a warehouse in Pembroke on May 16, and depriving the woman of her liberty on May 1.

Rogers, who pleaded not guilty to the offences, represented himself in front of Magistrate Edward King in Magistrates' Court yesterday.

Testifying on Rogers' behalf, his girlfriend Chandra DeBraga maintained that Rogers did not commit the offences because he was with her during the time the offences were allegedly committed.

The trial was adjourned and continues in Magistrates' Court today.

Rogers recently made headlines when he broke through a wall while in custody at the St. George's Police Station in late July and eluded Police capture for a week.

He is currently serving a six-month prison sentence for the offence.

POLICE INVESTIGATE SUSPICIOUS DEATH OBT Police investigate suspicious death Police are investigating the suspicious death of a 37-year-old man who was found in a Southampton church car park yesterday morning.

The man was discovered around 8 a.m. at the St. Anne's Hall parking lot. He was taken to King Edward VII Memorial Hospital and pronounced dead.

The Police will not release additional information until the next of kin has been notified.

SHORT SENATE SESSION EXPECTED SEN Short Senate session expected A short Senate session is expected today before senators rise for the summer break.

Senate president Alfred Oughton said he did not expect any of the debates to stir too much controversy, with the possible exception of the Proceeds of Crime Act.

The Senate will also consider two draft regulations entitled `The Government Fees Amendment Regulations 2000' and a resolution to exempt Lawrence Ltd., a company which has brought in a new tourist boat, from customs duty.
