was stabbed in the head with a knife was acquitted in Magistrates' Court yesterday.

Roger Fox, 30, of Woodlands Road, Pembroke told the court he "did not wish Michael Robson any harm'' and he "was sorry the situation went the way it did''.

Fox denied kicking Robson in his head after he was stabbed in the left temple by Randy Benjamin Jr.

Benjamin is presently serving a four-year prison sentence for the offence after being found guilty by a Supreme Court jury in February.

Fox said that at around 3 a.m. on July 19, 1993 he at the Ice Queen restaurant eating when a fight broke out in front of his car. He said he did not want anything to happen to his car so he got up to break up the fight.

"A white guy was leaning on my car so I told him to get off,'' he said.

At that point, the man gripped his shirt and refused to let go.

He said he put his foot on the man's chest and pushed him away. The man fell face down on the ground and that was when Fox first saw a knife sticking out of Robson's head.

Fox said he thought Robson was dead so he panicked and jumped in his car and drove away.

Acting Senior Magistrate the Wor. Edward King said the prosecution had failed to prove beyond a reasonable doubt that Fox was the man who had kicked Robson.

He also said he did not believe Fox's explanation of the night's events was "far-fetched'' before he acquitted him.
