Murder trial will go ahead

The trial for the man accused of murdering Nicholas Dill on Boxing Day two years ago will begin on December 1.

Andre Kirk Everett Hypolite 33, denied stabbing Mr. Dill to death at his home on Pearman?s Hill on December 26, 2004.

Yesterday lawyers appeared in Supreme Court to update Justice Norma Wade Miller.

Crown counsel Paula Tyndale told Justice Wade Miller that the prosecution had received a blood spatter report yesterday from an overseas expert and the defence had not yet examined it.

The crown was also awaiting psychiatric reports to be finished by the Mid Atlantic Wellness Institute before the trial could proceed.

Hypolite?s lawyer, Shade Subair, asked for the court to delay the trial, which was supposed to start next week, because she would need to find an expert to examine the various technical evidence that the Crown has disclosed.

The trial was moved from November 2 to December 1 to ensure that all the necessary evidence and expert testimonies would be complete.
