A judge yesterday threw out a case against a youth accused of assaulting a teen with a baseball bat because there was not enough evidence to identify him.

Assistant Justice Archibald Warner ordered the jury to deliver a not guilty verdict against Rashad David George Cooper, 20, who denied causing grievous bodily harm to Niedel Swan outside Hamilton Parish Workman's Club on April 10 last year.

He said there was only a general description of the attacker which would not allow the jury to identify who carried out the assault.

Mr. Swan, of Crawl, Hamilton Parish, who was 18 at the time of the attack, received a broken jaw and cheekbone and had to have his teeth wired together.

Witnesses said a youth in a white jacket hit Mr. Swan on the head from behind then several more times as he was lying on the ground.

Mr. Swan said in evidence that another youth, David Smith, had admitted to him later that he carried out the attack.

Lawyers spent all day on Thursday in legal arguments in the absence of the jury about the admissibility of evidence.

Director of Public Prosecutions Kulandra Ratneser said yesterday he was unable to comment.
