by a Pembroke man, recently slapping him with $2,000 in fines or 60 days in jail. Neguy Herman Franklin nodded in acknowledgement after Mr. Warner refused to grant him "time to pay'' the fines.

Franklin pleaded guilty to assaulting an officer in the execution of his duty, using offensive words, driving an unlicensed car without third party insurance.

Mr. Warner told the 31-year-old, Fenton's Drive man: "I have heard you on your application for time to pay and that you have not been working.

"The fines for assaulting a Police officer and offensive words must be paid forthwith,'' he added. "Mr. Franklin, I have spoken. And if you don't like any decision in this court there is a superior court for you to go to.'' Franklin had just explained he had pushed the Policeman because the officer grabbed him on his injured left forearm.

"This arm was broken and dislocated,'' he said. "Yes, I did say all of those things. And I did have a couple of drinks.

"But it wasn't towards the Police officer or Police or anything. When somebody squeezes your hand and you've got a metal rod in it, it don't feel too nice.'' Franklin explained he has not been working for several months while his arm healed but admitted the cast had been removed and therefore the officer would not have known about the injury.

He added: "Yes, your honour. He didn't know. I did push him down because of the pain, not because of aggression towards him.'' The incident occurred on a Sunday morning on Angle Street, near the junction with Union Street at 3 a.m.

Prosecutor Graveney Bannister told Mr. Warner that Police arrived to find Franklin's car blocking traffic and Franklin standing in the road.

He moved his car voluntarily but became "verbally abusive and shouting at the top of his lungs''.

Mr. Bannister said Police "tried to reason'' with Franklin who responded by pointing at the officer "in a very threatening manner'' and shouting: "You're a f***ing foreigner! I'm f***ing Bermudian and you can't talk to me like that. You want some of me? Come on, you try and take me,'' he added.

"I'll beat you in this car park.'' Mr. Warner told Franklin: "I've considered what you've had to say. I believe this still to be totally unacceptable.

"Totally unacceptable,'' Mr. Warner explained. "The $1,000 fines for the assault and offensive words are to be paid today. The $1,000 and $750 fines for no insurance and unlicensed motor car are to be paid by October 16.

It is understood the fines were paid.
