A lawyer for a teacher accused of molesting a schoolboy yesterday called for the case to be thrown out, accusing the boy of being a liar who lived in a "fantasy world".

The teacher, who cannot be named for legal reasons, is accused of touching the eight-year-old boy's penis for sexual purposes in a classroom in January this year.

The alleged victim continued giving evidence yesterday when he denied to the defendant's lawyer Larry Mussenden that he was telling lies.

Mr. Mussenden spent the afternoon arguing before Magistrate William Francis that there was no case to answer and his client should walk free.

Mr. Mussenden highlighted 16 alleged inconsistencies in the evidence, and he had not finished making his "no case" submission.

Mr. Mussenden told the boy, who also cannot be named: "You make up stories, don't you?"

He replied: "No".

"You have a wild imagination". "No".

"You say things that aren't true." "No, I don't"."

In fact, you tell lies, don't you?" "No".

"I suggest to you the things you said about (my client) touching you are not true." "Yes they are."

"I also suggest you are a liar." "No I'm not."

Det. Sgt. Barry Richards read a statement of an interview he conducted with the defendant in February this year in which the accused deny stroking the boy's hair while sitting nexet to him in the classroom in the presence of others.

When asked if he pulled the boy's penis, the defendant replied to Police: "No, absolutely not."

Mr. Mussenden told Mr. Francis there was no cases to answer because of a series of inconsistencies in the evidence, adding the boy was "living in a fantasy world".

Crown counsel Anthony Blackman will argue against the no case submission on Monday.
