A 20-year-old man was discharged yesterday because two Police witnesses did not show up for his Magistrates? Court trial.

Kyhon Smith, 20, of Sylvan Dell Road, Paget was charged with throwing a glass bottle on November 11, 2003.

Smith came to court in his Regiment uniform because he is enrolled in recruitment camp. Magistrate Edward King told the court: ?The Regiment should have arranged for him to come in his own clothes.? Crown counsel Shakira Dill said: ?I don?t see the witnesses ? I have no indication why they are not here. I ask that you give me more time to make an inquiry. The Crown cannot proceed at this time.? Mr. King did not grant more time.

Defence lawyer Larry Mussenden said: ?I ask that the charges be dismissed.?

Mr. King told the court: ?The Prosecutions witnesses have failed to appear without reasons, making it impossible for Crown counsel to proceed. The matter is dismissed.

?The defendant is discharged.?
