But Senior Magistrate Archibald Warner warned Shawn Swainson that he would have to sell his motorcycle to pay $2,400 in new traffic fines.

Mr. Warner fined Swainson again rather than activate two suspended prison sentences because the offences for which he appeared yesterday were not presented before the court on February 1st.

It emerged Swainson was stopped for not having third party insurance, riding while disqualified and using an unlicensed motorcycle, but he was arrested on outstanding matters. Swainson, 19, of Talavera Lane, was presented before Mr.

Warner at 10 a.m. that day but only the outstanding matters were dealt with.

Swainson had nine speeding and three disqualified driving convictions in the year 2000 and promised Mr. Warner then he would not ride until he is legally able in October 2003.

"I would have thought that they (the new charges) would have been dealt with all at the same time,'' Swainson said. "I've learned my lesson. A fine wasn't paid so I spent a week up at Westgate. It's not easy up there. Many of the inmates talked to me and I learned my lesson. Guys told me that it was no place for a 19-year-old for speeding tickets.'' Mr. Warner said he was not going to activiate the suspended sentences but warned him that he would be sent to prison if he appeared in court again.

The defendant asked for time to pay but was told that his bike would be taken off him and sold to pay the fines.

He was ordered to pay the fines the same day.
