defective from the date of purchase won a judgment for much less yesterday in Magistrates' Court.

Candace Fox, of Cove Valley, St. George's, said she bought the bike from Eve's Cycles on October 6, 1995 and the trouble with the bike started that day when the RPM cable (linked to the gears) broke and two weeks later the piston blew.

Ms Fox -- who was not represented -- said the bike was in the shop for repairs a total of five times, including three times at Eve's Cycle when the bike was still under warranty and twice when she had it repaired by Cycle Repairs at her own expense.

But Eve's Cycles lawyer Michael Scott asked Ms Fox how it was she felt Eve's was responsible for the repairs the bike needed after the warranty had expired.

She answered that in the short time she owned the motorcycle she had to replace the starter twice and the carburettor three times. That, she added, was not normal for a bike.

While noting that the required repairs were unusual, Magistrate Arthur Hodgson said Fox was not an expert on such matters.

Mr. Hodgson explained to Ms Fox, who did not seem to understand that she could not sue for the entire amount of the bike, that he could only award her the cost of the repairs.

After determining the parts which Ms Fox had paid to repair, he ordered Eve's Cycles to pay $355 to her for the starter and carburettor.
