November, 2000 - Ministry of Works and Engineering pre-qualifies contractors - five make presentations

November 2, 2000 - pre-qualification report prepared by the Ministry, rating contractors as low, medium or high risk

November 2, 2000 - the three most qualified contractors were identified (Pro-Active was not among them and was rated 'high risk')

November 28, 2000 - all five contractors invited to tender

March 2, 2001 - Pro-Active Lubben Group second lowest bidder at $68,164,841 and Bermuda Tech/Ellis-Don lowest bidder at $62,987,435

March 9, 2001 - Bermuda Tech submits a more detailed report on pricing for the project (Bills of Quantities) including schedules, insurance and bonding

March 14, 2001 - a letter requesting further information is sent to Pro-Active on the instruction of Minister Alex Scott

April 17, 2001 - Ministry recommends to Cabinet that the contract be awarded to Bermuda Tech

April 17, 2001 - Cabinet award the contract to Pro-Active

May 10, 2001 - a letter informing Pro-Active that they have won the contract is made

May 28, 2001 - Premier Jennifer Smith and Works and Engineering Minister Alex Scott hold a press conference and announce that Pro-Active has won the contract

June 4, 2001 - Pro-Active and Government sign the contract for the project

June 4, 2001 - a performance bond (surety) was issued by Union Asset Holdings Ltd.

June 15, 2001 - Union Asset Holdings Ltd. incorporated with 12,000 shares. All shares owned by Bermuda Industrial Union

June 18, 2001 - work begins on the site with a projected completion date of September 4, 2003.

August 31, 2001 - Pro-Active had received $20,248,859 for work completed

September, 2001 - $450,000 paid to Pro-Active (includes an amount not approved by the quantity surveyor)

October, 2001 - the Ministry paid Pro-Active suppliers directly:

Argus Insurance $289,835.00

R-Co Steel $183,734.58

Aluma Sytems $47,118.00

December 11, 2001 - Acting Permanent Secretary for the Ministry approves payment of $700,000 to Pro-Active (reimbursement of the bond)

April 12, 2002 - letter from the Acting Permanent Secretary confirms that Pro-Active will be paid twice a month instead of the contracted once a month. The letter describes the accelerated payments as a concession by the Ministry.

July, 2002 - Ministry gives Pro-Active $500,000 additional advance with the mid month payment. It was deducted at the month end payment.

August, 2002 - Ministry gives Pro-Active $500,000 additional advance with the mid month payment. It was deducted at the month end payment.

October 24, 2002 - Ministry staff see the performance bond for the first time

October, 2002 - Auditor General's special report on the Berkeley Institute Senior School capital project submitted to the Speaker of the House of Assembly.

November 22, 2002 - Auditor General's special report tabled in Parliament.
