The trial of cruise ship workers Alvin Francois and Trevor Morain, who are facing four drug charges including importing cannabis, was scheduled to get underway yesterday.

But defence lawyer Archibald Warner asked Puisne Judge Norma Wade for an adjournment, explaining that the arresting officers were the same ones under investigation for alleged inappropriate conduct in the Ellsworth Wilson drug case.

"It would be unfair and not in the interest of justice for us to proceed when we know evidence will hinge on the credibility of the officers involved,'' Mr.

Warner said.

But Crown counsel Khamisi Tokunbo told Mrs. Justice Wade that the Francois and Morain case was a different case with different facts.

After ordering a recess to consider all sides of the argument, Mrs. Justice Wade granted Mr. Warner's application.

She agreed the defendants would have a strong argument for appeal if the case proceeded and the allegations against the officers involved were proved.

Francois and Morain were orginally scheduled to go on trial on May 6. But after days of legal arguments it was adjourned due to the fact that a member of the jury panel had made previous arrangements to travel and the trial was next expected to finish in time.

The trial was therefore rescheduled to begin after the Wilson case which has been adjourned until June 19.
