A 29-year old Devonshire man and his mother caused quite a scene in Magistrates' Court.

Gerry Fubler, of Roberts Avenue, Devonshire, pleaded not guilty to speeding, insisting to the court that he was being tried for the same thing over and over again.

"It's a repeat cycle for me. I was here before for the same matters,'' he said. "Every time I look, I'm getting arrested.'' And when his mother added her protest, she was ordered from the court by acting Senior Magistrate Edward King.

Mr. King asked him again how he pleaded, Mr. Fubler repeated "not guilty''.

Mr. King informed him that no evidence had yet been offered for an offence he had allegedly committed on June 11, 1998. The court heard that neither Fubler nor his lawyer appeared in court.

"That's why they keep arresting you,'' Mr. King said.

"The law is two-sided for me,'' Mr. Fubler said, claiming that the Police officers involved in his case were the ones who were not showing up for court, not him.

Mr. King set a trial for May 23 and released Fubler on bail of $1,000 with a like surety, stressing that the surety could not be Fubler's mother, who had abused her obligations as surety before.

Fubler said: "Police don't show up and nothing happens to them.'' His mother, sitting in the back of the courtroom, asked Mr. King if she might speak. When Mr. King refused she continued to talk, even when he ordered that she be escorted from the courtroom.

A female Police officer laid a hand on the mother's arm in an attempt to lead her from the courtroom, and Fubler became enraged.

"Too quick with your hands,'' he accused, as his mother was led from the room.

"That's my momma!'' Mr. King attempted to read the trial date again as the mother appeared in the door of the courtroom once more, asserting what Fubler had said about Police officers not showing up in court. Then she disappeared.

Mr. King stressed that the bail he had set had not been increased, that the amount named was the amount previously set by Magistrate Archibald Warner.

Fubler became angry at this point, shouting at Mr. King: "Send me on my way, it's not a big thing! Send me on my way, judge. Send me on my way.'' Fubler continued to yell as he was escorted from Court.

"The hell with you and anybody like you!'' he shouted to Mr. King on his way out.

The yelling continued outside. Mr. King asked that Fubler be brought back into the courtroom but he did not re-appear in court.
