The news comes just a week before Smith's lawyers head to London to argue before the Privy Council that he should not face a re-trial in the Rebecca Middleton murder case.

Smith faces a charge of allegedly murdering of the 17 year old Canadian holidaymaker in July 1996. He is currently on bail pending the outcome of the Privy Council hearing.
