Teenager faces trial for alleged racial comments towards Police

A teenager is to stand trial next week accused of racially harassing two Police officers.Michael Coles Diel, 19, of Harbour Road, Warwick, appeared in Magistrates' Court yesterday on a total of six charges in connection with an incident outside Ice Queen on Wednesday.Diel pleaded not guilty to two charges of racially harassing two male officers, one charge of being in the care of a cycle while his ability to drive was impaired by alcohol or a drug, a charge of refusing to take a breathalyser test, harassing an officer while he was trying to arrest him and attempting to escape Police custody.

A teenager is to stand trial next week accused of racially harassing two Police officers.

Michael Coles Diel, 19, of Harbour Road, Warwick, appeared in Magistrates' Court yesterday on a total of six charges in connection with an incident outside Ice Queen on Wednesday.

Diel pleaded not guilty to two charges of racially harassing two male officers, one charge of being in the care of a cycle while his ability to drive was impaired by alcohol or a drug, a charge of refusing to take a breathalyser test, harassing an officer while he was trying to arrest him and attempting to escape Police custody.

Diel was represented by defence lawyer Richard Horseman. He will appear in court on Monday at 9.30 a.m. for trial. Until then he was released on $5,000 bail with one surety and ordered to report to Hamilton Police Station each day between 8 a.m. and 8 p.m., abide by a curfew between 9 p.m. and 7 a.m. and surrender all travel documents.

Another 19-year-old, Connor Alexander Morrison,19, of Windcrest Drive, Paget, was fined $1,000 in Magistrates' Court yesterday after admitting driving while more than three times the legal limit.

The court heard that around 2.25 a.m. on Wednesday, Police responded to a report concerning two men outside Ice Queen, in Paget.

Officers arrived at the scene and noticed Morrison's speech was slurred, his eyes were glazed and that he had the keys to his auxiliary cycle in his hands. He was cautioned, but made no reply.

Morrison was taken to Hamilton Police Station and given a breathalyser test which showed he had 255 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80.

Senior Magistrate Archibald Warner yesterday disqualified him from all vehicles for 12 months and gave him ten demerit points, in addition to the fine.
