assaulting his wife is set to run into a third week after Puisne Judge the Hon. Mr. Justice Meerabux called for an adjournment yesterday afternoon.

He announced he would begin his summation of the trial on Monday morning. A verdict by the seven-man five-woman jury is expected the same day.

The accused, a 52-year-old man, has denied committing serious sexual assault on his wife and doing her bodily harm on August 18 last year.

The woman, who claims she blacked-out during the act, said she repeatedly told her husband to stop but they were interrupted when her nephew burst in on them.

Her nephew said he kicked open the door after hearing a gasp and found the accused lying on top his wife choking her with his hands.

The accused has claimed his wife was a willing participant and that he was fondling not choking her.

In his closing speech Mr. Douglas claimed that while the accused contradicted himself under cross-examination as to who initiated sex, the woman remained adamant that the act was not consensual.

However, Mr. Warner told jurors there was no physical evidence to show the assault had taken place. He added that the woman's testimony which was riddled with inconsistencies and memory lapses, was unreliable.
