Neville Smith of Riviera Estate, Southampton, was watched by Police as he drove along Pitts Bay Road, Pembroke at 2.15 a.m. on August 8.

Crown counsel Caitlin Garland told Senior Magistrate Will Francis that they observed Smith swerving and driving in a jerky motion "for no apparent reason''.

While speaking to Smith, Police noted he appeared to be drunk and when asked if he would take a breath test for impaired driving, Smith, 64, told Police: "I'll take the test. I don't have a problem taking the test.'' Smith failed the test with a reading of 241 milligrams of alcohol in 100 millilitres of blood. The legal limit is 80 milligrams of alcohol in 100 millilitres of blood.

Mr. Francis fined Smith $500 and banned him from driving all motor vehicles for one year.
