station has breached Bermuda's laws against gambling.

Puisne Judge the Hon. Mr. Justice Ground dismissed the Crown's application for a declaration that bingo was an illegal lottery, therefore, should be taken off the air immediately, Bingo lawyer Mr. Richard Hector said.

Mr. Hector said the judge had ruled the bingo issue should not be considered any further until criminal charges pending against VSB were settled.

April 17 has been set down to hear those proceedings.

VSB TV Bingo will be back on the air on January 14.

Crown counsel Mr. Peter DeJulio, who is handling the case, said Government still intended to move towards an injunction to kill VSB TV Bingo.

He added the proposed injunction and criminal charges were part of a "two-pronged'' legal assault on bingo.

Criminal charges were laid last December against Freeport Gardens Bingo organiser Mr. Neil Inchcup and VSB operator DeFontes Broadcasting Television Ltd.

Station boss Mr. Kenny DeFontes has pledged TV bingo will continue on Saturday nights despite the legal controversy.

He has also questioned why a writ has not been served on Bermuda Broadcasting Company for holding bingo at Southampton Rangers.
