Acting Senior Magistrate Edward King determined that he had repented.

Derek Levar Hart of Cox's Hill, Pembroke was charged with attempting to pervert the course of justice by providing false information to Police when he was stopped by them and issued with a ticket for not having a valid licence on March 23.

Hart pleaded guilty to the charge and Crown counsel Wayne Caines told the court that when Hart had been stopped at a random check he gave his name as Michael Woolf.

When a Police search revealed that `Michael Woolf' did not have a driver's licence, a ticket was issued to Hart in that name.

Just over one month later, Hart went to Police of his own accord and told them he had given a false name. He was then charged with perverting the course of justice and issued a ticket in his own name for driving without a licence.

Mr. King asked Hart why he had turned himself in. "I wanted to do the right thing,'' said Hart.

Mr. King told the court that Hart's offence was the second of that nature in two days and the fourth in recent months and that two of those four individuals were sent to Westgate for the offence.

"This is a serious offence,'' he said.

However, Mr. King elected not to convict Hart after asking if he'd brought his toothbrush with him. Mr. King said that Hart had a clean record and had recanted and admitted what he had done.

"I shall not convict you but I bind you over to be on good behaviour for 12 months,'' said Mr. King.
