Magistrate the Wor. John Judge yesterday heard that 40-year-old Jerome Pitcher is a paraplegic as a result of the accident that occurred July, last year near Palmetto and Bishop Spencer roads.

And he therefore could not show up at the trial set for August 26 to testify against 21-year-old Shawn Antoine Simmons.

Simmons, of Sunnyside Park Lane, Southampton, is accused of causing Pitcher actual bodily harm by dangerous driving. He denies the charge.

Insp. Duffy said arrangements would be made with King Edward VII Memorial Hospital to obtain Pitcher's evidence.

Simmons, who suffered injuries to his jaw, left arm and left leg from the accident, was granted bail in the sum of $500 in his own recognisance.
