Minister sued over planning decision
Salt Kettle -- including one claiming the Environment Minister is in contempt of court.
Mr. Charles Green and his wife Mrs. Carol Green have named their neighbour Mr.
Peter H. Darling and Environment Minister the Hon. Ann Cartwright DeCouto in the Supreme Court actions.
Mr. Darling had appealed to the Minister after the Development Applications Board rejected his proposal to build a single storey addition that would have touched the wall dividing his property from the Greens'.
The Greens objected to the plan, but Mrs. Cartwright DeCouto granted the appeal. The Greens then appealed to the Supreme Court, complaining that Mrs.
Cartwright DeCouto had toured the site on Salt Kettle Lane and spoken to Mr.
Darling while they were not present.
Chief Justice the Hon. Sir James Astwood decided in favour of the Greens. He said the Minister "must be seen and be perceived to be acting fairly.'' He sent the matter back to the Minister for a rehearing.
The Greens appealed that portion of the decision, while the Minister appealed the entire decision. A court date has been scheduled for late July, but on May 13 the Minister ruled again in favour of Mr. Darling.
