Franklyn Smith, of Mount Hill, said he was tired of being sexually harassed by the complainant and was only defending himself after the man threatened him with a bottle.

Smith, 31, first pleaded guilty to the unlawful wounding of May 28 but after hearing his sentence on Wednesday, wanted to change it.

"There's no way I should have to do three months,'' he told Senior Magistrate the Wor. Will Francis. "It was in self-defence.'' Police prosecutor Insp. Peter Duffy said the man was with friends at Par-la-Ville park in Hamilton when Smith approached him saying "No faggots in the park'' and warned his friends not to hang around him.

Insp. Duffy said Smith then picked up a three-foot long metal pipe and hit the man on the left side of his head. The man fell to the ground and Smith hit him across his left leg.

The man was bleeding profusely from his head and passers-by suggested someone call an ambulance.

Smith took the man to the King Edward VII Memorial Hospital emergency room where he required four stitches to close the wound to his head. He also sustained bruising to his lower left leg.

Insp. Duffy said Smith first denied the charges but was identified by the man.

"It would seem the complainant is one who has for the last two months been bothering Smith in such a way as to make sexual overtures toward Smith,'' said duty counsel Miss Sonia Grant.

She said Smith called the man a "faggot'' because "the complainant was saying such things as `I still like you' and `you're cute' and other such references. The accused wants nothing to do with this gentleman. He's not of that nature at all.'' "I've given you the benefit of every doubt concerning provocation,'' Mr.

Francis told Smith. "But there is just too much use nowadays of weapons causing injury to people. This was a nasty head wound to this person's head and wounding of this sort, I just cannot treat it lightly.''
