A man threatened to kill prosecutor Wayne Caines after he was remanded in custody on Friday in Magistrates' Court.

Donovan Nesbitt had pleaded guilty to violating a restraining order on March 19 and was about to be remanded in custody while the court checked his explanation for the offence when he formed a gun shape with his fingers, pointed at Mr Caines and said: “I'm gonna kill you.” He then went: “Bang, bang”.

He had earlier told the court that the reason he was on the property was because he had called his grandmother several times out of concern for her and there was no answer.

“So I got worried and decided to go and see if she was okay. When I got there she was on the floor and had suffered a stroke. I telephoned 911 and my father and they both asked me to stay with her. A few minutes later Police arrived and I was arrested and in custody ever since.”

Acting Senior Magistrate Greaves asked: “Who do you think called the police?”

Donovan said: “I think it was my father.”

Nesbitt's grandmother Mrs. Mona Brangman has countersigned a statement saying that she has had enough of his cursing and stealing.

Mr. Greaves has decided to give Donovan the benefit of the doubt whilst awaiting confirmation of his explanation.

Mr Caines after listing a catalogue of offences said: “Sentencing is entirely up to you, your worship.”

Nesbitt has been remanded in custody until April 24.
