Witness identified defendant in video from murder scene

The Supreme Court heard evidence that a witness identified a man accused of murder on CCTV footage captured at the scene of the crime.

The witness told police in a recorded identification procedure that she recognised a man seen emerging from the backseat of a black car as “definitely” being Davin Dill.

Asked in the recording how she recognised Mr Dill, she noted his height, build and skin tone.

Speaking in court yesterday, the witness — who cannot be identified for legal reasons — said she was close to the victim, Joshua Rowse, and that she “knew of” Mr Dill from her school days.

She told the court that she had seen him around various locations in Warwick but did not hang out with him, adding: “I’m not saying I would see him every day.”

Mr Dill, 27, has denied charges that he murdered 22-year-old Mr Rowse in an incident on June 14, 2020, and that he had a bladed article, specifically a knife, in a public place.

The court was previously shown CCTV footage from the Rubis service station on South Road in Warwick in which Mr Rowse and others were seen to arrive at the station shortly after 7pm.

While Mr Rowse stood outside the store, a black car is seen to pull up and two men get out, one from the passenger’s seat and the other from the backseat on the driver’s side.

The men chased Mr Rowse around the side of the building, with the black car following behind.

Seconds later, Mr Rowse was seen to walk back into frame hunched over and holding his abdomen.

As the trial continued yesterday, the court heard that Mr Rowse suffered 14 wounds to his chest, arms and legs along with a number of bruises and abrasions.

The injuries included one stab wound which went through part of the left ventricle of Mr Rowse’s heart and another that punctured his left lung.

The trial continues.
