Date set for gas station murder trial
A trial for the 2002 vicious gas station murder of a Hamilton Parish woman will finally be held in June.
In yesterday?s Supreme Court arraignment session Chief Justice Richard Ground scheduled the long awaited trial of George (Messy) Macdonald Liburd 32, for June 20. Liburd, of Pembroke, has denied murdering mother-of-three Chena Danette Trott, 32, at the Esso TigerMarket on Crawl Hill in Hamilton Parish in August 2002. He is represented by Queen?s Counsel John Perry.
In November 2004, The Women?s Resource Centre criticised Bermuda?s justice system for the delay in the start of Liburd?s case.
The remainder of yesterday?s arraignment session was dominated by serious assault charges, though Chief Justice, Richard Ground, also dealt with several defendants who appeared on charges of robbery and drug possession.
The four Pembroke men responsible for the brutal torturing of Dwayne Trott on January 4, 2001 appeared for mention yesterday. However no date could be set for their sentencing.
Jakai Tyrone Hartford 22, Shaki Allen Jay Minors 21, and John O?Donnell Fox 34, and Antoine Herbert Anderson, 27, will all appear again for mention before Puisne Judge Carlisle Greaves on January 14.
Anderson, of St. Monica?s Road, was convicted last month of causing Trott grievous bodily harm and intending to burn, maim, disable or disfigure with the intent of doing grievous bodily harm.
In the week before Anderson?s trial, Hartford,of Mission Lane, Fox, also of Mission Lane, and Minors, of Cherry Hill, had all pleaded guilty to the lesser charges of grievous bodily harm and actual bodily harm in relation to the incident.
Mr.Justice Ground was prepared to set down a date for sentencing for the four men, however a Social Inquiry Report for Anderson would not be completed in time.
Rather than sentence Anderson on a later date than Minors, Fox and Hartford, Mr. Justice Ground decided to have the four men appear on January 14 before Mr. Justice Greaves, who presided over Anderson?s trial.
?I?ll hand all of these matters over to Mr. Greaves and he can sort them out,? Mr. Justice Ground said.
Only moments later Anderson was back before Mr. Justice Ground for mention in a separate case of kidnapping Tarik Williams on August 27, 2004.
Both Anderson and co-accused ? David Jahwell Cox 24, of Orchard Grove, Pembroke ? deny charges of kidnapping , grievous bodily harm, robbery and demanding property with menace and intent to steal from Mr. Williams. The two men are represented by Mark Petingill and will appear again for mention on February 1.
20-Year-old twins, Jevon Marco Douglas and Jeron Marcus Douglas from My Lord?s Bay Lane in Hamilton Parish, pleaded not guilty to a charge of robbery, and a separate charge of wounding with intent to do grievous bodily harm. Neidel Kevon Swan, 21, from Crawl Point Lane West in Hamilton, a co-accused also pleaded not guilty to the two charges. The case stems from an alleged robbery and assault on a man on July 9, 2004.
The accused were represented by Richard Horseman.
Tariq Shakenn Whit, 24, from Summit View in Hamilton Parish, pleaded not guilty to a charge of wounding with intent to do grievous bodily harm for allegedly attacking a man on August 5, 2004.
He was represented by Elizabeth Christopher.
Winston Wellington Burgess Jr., 41, from Suffering Lane in St. George?s, pleaded not guilty to a charge of wounding with intent and possession of an offensive weapon when he allegedly attacked Howard Burgess on August 15, 2004. Bail was extended and he will appear for mention on March 1 and was represented by Darrell Clarke.
Takayhi Walker, 19, from Peak Lane in Pembroke, pleaded not guilty to a charge of possession of a controlled drug, cocaine, with intent to supply. He was arrested on May 26, 2004. He was represented in court by Victoria Pearman. He will appear for mention in the Supreme Court on March 1.
A 40-year-old Warwick Parish man, who can not be named for legal reasons, pleaded not guilty to allegedly sexually assaulting a minor on June 30, 2004.
Bail was denied and he was remanded in custody to reappear on March 1. He was represented by Peter Farge.
A trial date of July 11 was set for Meyrick Desmond Patrick, 45, of Kentworth Court, Birmingham. Patrick pleaded not guilty to importing and possessing heroin intended for supply on June 24 2004. He was remanded until February 1 for mention.
A 39-year-old man accused of robbery will be tried in May. Joseph Moniz Lima, 39, of no fixed abode, is charged with robbing Taberry Amaral of his motorcar and wallet on March 1. Lima was remanded until his May 3 trial.
A sentencing date was scheduled for Aldo Nelson Pace 48, who owns Aldo?s Carpet on North Shore Road. Last September, Pace pleaded guilty in Supreme Court to handling cocaine on March 28, 2003 with the intention to supply.
Shane Edmund Todd 29, of no fixed abode, was remanded until he appears again for mention on February 1.
Victoria Cashmay White, 40, will appear for sentencing on February 25. White has admitted importing cocaine into Bermuda on February 29, 2004.
Troy Oneil Robinson, 35, of Anchorage Lane, St. George?s will appear again today for mention. Robinson has pleaded guilty to stealing Erica Wills? motorcar on August 22, 2004.
Rodwell Edmond Symonds and Orlando Lee Burch are to appear in court for mention again next month.
Davey Orlando Acka and Venessa Judy Tucker will return on February 1 to fix a date for sentencing and Michael Skinner will return on Feburary 1 to fix a date for trial.
Leonald O?Donnell Rayner will return to court on June 14 for trial, while Jay Chantez Ming will return on April 25 for trial.
Chris Anderson will return for trial on May 3.
The Director of Public Prosecutions,Vinette Graham-Allen, represented the Crown on all of the above arraignments.
