Uninsured drink-driver gets three-year ban

A driver was banned from the roads yesterday and fined $3,550 for a string of traffic offences.

Kaven Gibbons pleaded guilty at Magistrates' Court to failure to provide a breath test after he was stopped by police hours earlier.

Prosecutor Jaleesa Simons said police pulled Gibbons over after they saw a motorbike that was unsteady and swerving all over the road in Devonshire at about 3.25am yesterday.

The court heard that the rider did not stop when police used their lights and siren and then he ran a stop sign.

Miss Simons said that when officers eventually stopped Gibbons, 34, they “smelled intoxicants similar to that of alcohol”.

Police said his eyes were glazed and he was unsteady on his feet. The officers told Gibbons they believed he had been drinking.

Gibbons said: “I know, it's my fault.”

The court heard police checks revealed that the bike's licence had expired and Gibbons, from Warwick, was disqualified from driving.

The defendant initially agreed to take a breath test, but at Hamilton Police Station he refused to provide a sample.

Magistrate Khamisi Tokunbo fined Gibbons $1,000 for the offence and disqualified him for two years.

He was fined a further $1,000 and banned for three years, to run concurrently, for driving while disqualified.

Gibbons was also fined $1,550 for driving without insurance, having an unlicensed bike and failure to stop when signalled by police.
