Man jailed four months for inducing 15-year-old boy to do an indecent act

A 23-year-old Devonshire man who induced a 15-year-old boy to masturbate in his presence has been jailed for four months.Miguel Estrella, of Upland Lane, pleaded guilty on December 14 to attempting to cause or induce a child to commit gross indecency.The offence occurred on an unknown date between June 1 and July 31 of last year.Lawyer Jennifer Howarth told Magistrates’ Court her client was a first-time offender who had entered an early guilty plea, and shown great remorse during the past six weeks in Westgate Correctional Facility.“You will not see him before these courts again,” she told Senior Magistrate Archibald Warner. “He begs you to pronounce as lenient a sentence as possible.”According to a victim impact statement read before the court by Crown counsel Nicole Smith, Estrella’s teenage victim was unable to eat for weeks after the experience.He suffered from humiliation and the inability to trust others, and felt paranoia and “debilitating fear” around men.The victim was interested in modelling and the statement said Estrella offered advice on the subject before coaxing him into the act.The victim’s statement added: “I thought I was tough, but thanks to Miguel, I am weak and tiny, not a man.”He added: “I feel lower than I have ever been, to the point of scaring myself.”The victim had looked up to Estrella, his mother said in a statement.Estrella was “in a position of trust, and took advantage of his innocence,” her statement read.She said her son had been left “constantly trying to cleanse the experience out of his mind”.Mr Warner called the statement “powerful, if not painful” and said the impact on the victim and his family had been devastating.“I must consider the need for the community to be protected from this offender, and notwithstanding any reports that say he is at a low risk of reoffending, sexual propensities do not simply go away,” Mr Warner told the court.The maximum sentence for the offence is 12 months’ imprisonment.Mr Warner added: “I don’t want to seem to minimise it, but it boggles the mind, how many different types of gross indecency there are that can be more serious than this. However, this calls for an immediate custodial sentence.”Mr Warner sentenced Estrella to four months in jail, with time spent in custody taken into consideration, plus two years’ probation.
