Road ban and fine for man who refused breathalyser test

A Smith’s man was taken off the roads for 18 months after refusing to take a breathalyser test following a road accident.

John McElroy, 57, pleaded guilty to the offence when he appeared in Magistrates’ Court yesterday.

Paul Wilson, for the Crown, told the court that McElroy was driving west along Harrington Sound Road in Hamilton Parish on June 5 when he hit a nearby wall and fell off his bike.

He admitted to drinking when police officers attended the accident scene.

McElroy was taken to Hamilton Police Station after the accident, but refused to take a breath test.

In addition to being banned, McElroy was ordered to pay a $1,500 fine.
