Pembroke man off road for failing to give breath sample

A Pembroke man has been banned from the roads for 18 months for failing to comply with a demand for a breath sample while suspected of driving under the influence.

Osvaldo Soares Correia, 40, denied driving while his ability to do so was impaired by alcohol or drugs, but admitted failing to give the sample for analysis.

He was also fined $1,500 for the offence, which contravenes the Road Traffic Act 1947.

Magistrates’ Court heard that on April 4, Correia was stopped at a roadside sobriety checkpoint on South Road, Paget, where police officers said they smelt alcohol on his breath.

Correia then failed to comply with the request for a breath sample without reasonable excuse.
