Police have described a recent increase in sexual assaults reports as cause for concern, reminding the public that assaults can occur between strangers and within friendships, relationships and marriages.

A Bermuda Police Service statement said several reports showed that “consent remains an ongoing issue, with instances where the withdrawal of consent is not respected”.

The Bermuda Criminal Code defines the offence as any assault accompanied by circumstances of a sexual purpose. It can involve unwanted touching or sexual acts without consent, and may occur through “physical force, coercion, threats or other circumstances where a person has not consented”.

Police reminded the public of a duty to notify partners of any known sexual transmitted diseases before engaging in sexual activity, as this may also constitute an offence.

The BPS defined consent as a “clear, voluntary and informed yes” by both parties that could be withdrawn at any time, and cannot be given if someone is asleep, unconscious or incapacitated by drugs or alcohol.

Silence, lack of resistance, or previous consent, does not mean consent.

Sexual assault can be prevented by respecting boundaries, speaking out against inappropriate or abusive behaviour, practising clear consent, complying if consent is withdrawn and supporting healthy and respectful relationships.

People should also be aware of their surroundings when out socialising, locate their nearest exits, always keep their drinks with them, use a drink cover where possible and immediately stop drinking if the beverage looks or tastes unusual.

The statement added: “Trust your instincts — if a situation or person makes you feel uncomfortable, leave the area and seek assistance from someone you trust or a member of the venue staff.”

Sexual assault can be reported by calling 911 or visiting any police station. The Centre Against Abuse can also offer confidential support.

The statement concluded: “If you see something concerning, speak up when it is safe to do so. Every action can make a difference.”
