Bermuda’s Employment and Labour Relations Tribunal will get extra powers of enforcement, backed by civil penalties for employers who fail to heed its rulings, through legislation amending the Employment Act 2000, MPs heard on Friday.

The Employment Amendment (No. 2) Act 2026 was tabled by Jason Hayward, the Minister of Economy and Labour, who told the House of Assembly it would bring into force a statutory framework for “dealing with persons who fail to comply with tribunal orders — including the establishment of a naming register for unpaid tribunal awards”.

Mr Hayward said it would give the tribunal additional “procedural tools necessary to manage its work, and a legislative framework that gives practical effect to its orders”.

The Act would also provide for measures that prohibit an employer from taking disciplinary action against an employee while on leave or off duty — and extends the timeline for the delivery of tribunal decisions.
